GM Finds Itself Defending Another 8-Speed Transmission Lawsuit in Michigan

General Motors recently announced it would be installing new transmissions in certain 2023 and 2024 Corvettes because of improperly torqued transmission fasteners, but that hasn’t stopped other customers from attacking the company with another lawsuit concerning older eight-speed automatic transmissions in several GM vehicles.

This suit is being filed on behalf of 13 customers who accuse GM of knowing that its 8L45E and 8L90 eight-speed automatic transmissions were defective but failing to correct the problem through recalls and replacements.

The problem with these transmissions, according to the suit, is that some of them have a defect that causes the valve bodies to hold air that isn’t properly purged – causing delays in acceleration, shuddering, lurching, and “poor shift quality” that could increase the risk of a crash.

The suit claims the problem normally shows up after the warranty expires, adding that while GM did offer transmission fluid flushes for free for the affected 2014 through March 2019 transmissions, it did not recall or replace the transmissions.

According to the suit, Corvettes aren’t the only vehicles affected by the alleged transmission problems, with others including the Cadillac CT5, Cadillac CT5-V, Cadillac CT6, Cadillac Escalade SUV, Chevy Silverado, Chevy Colorado, Chevy Camaro, GMC Canyon, GMC Yukon, GMC Sierra, and several others.

Two other similar suits about these transmissions have already been filed, one in Michigan in March 2023 and another in Canada in May 2023. The latest suit is Ulrich, et al. v. General Motors LLC, Case No. 2:24-cv-11007-JJCG-EAS, in the U.S. District Court for the Eastern District of Michigan Southern Division.

  1. As an owner of a 2015 that had to have the transmission flush (after a VERY bumpy ride from CT in the 2019 caravan) – how does this affect other owners? Usually class actions are sent to all affected consumers but I’ve only seen the news reports here.

  2. I had the dealer perform the free triple flush and fill five years ago on my 2016 Stingray and I couldn’t notice much improvement afterwards. I’ve also never received anything about a class action lawsuit.

  3. @Robert. I did see improvement but after five years I feel like it’s never been totally right. It may need another flush soon. I’m at 27,000 miles.

  4. Part throttle 1-2 shift on my 2019 Stingray the engine revs a bit before it goes to 2nd. Has done it since new I have 915 miles on it. Medium throttle or more is fine.

    Second appointment: 4/12/21-Good Chevrolet invoice #CVCS427519, Service Adviser Ms. Jenna Bittner: Customer states trans fluid leaking, since trans service, found puddled up around fill plug, leaking down to front of pan. will clean area and test drive. No charge.

    Third appointment:5/11/21 “Corvettes of Auburn,”, R&R- gasket, note: customer just had transmission service done at the dealership (Good Chevrolet) and it was leaking at the gasket, cost $301.93.

    (Total cost to flush my transaxle was $673.70)

  6. @Brian. My car does the exact same thing that Daniel says his does. On my car though it only hesitates on the first 1-2 upshift when I first take off after a cold start and it won’t do it again until the engine and trans completely cool down. Having the trans fluid flushed and filled didn’t really help this problem. My car is only at 7900 miles.

  7. @Robert. Yes. I noticed that exact thing taking my car out for the first time after winter storage this week. Driving up my driveway. It was strange. It’s done it before but it seemed more pronounced this time.

  8. @Brian. Evidently this is a common problem with C7 8 speed automatics. Since it’s just a quick minor issue after a cold start I just live with it. My dealership Corvette tech told me a while back that they were putting an improved Mobil 1 ATF in C7s that helped with this issue. I’ve thought about having it put in my car. With my car being way out of warranty I just haven’t pulled the trigger yet because I have to pay for it out of my pocket. I might break down and have it done at my next oil change.
