[VIDEO] Judges Set Court Dates for the Corvette Museum’s Motorsports Park

The National Corvette Museum’s appeal of a $100-a-day fine won’t be heard until the new year arrives.

Tuesday, Warren District Court Judge John Brown delayed a case update until Tuesday, Jan. 5 at 9 a.m. in the NCM appeal of the fine imposed on its Motorsports Park for not having a certificate of occupancy.

The fine was issued by the Warren County Code Enforcement Board on Sept. 11, two days after a hearing in which residents near the park complained about the noise levels being created by activities at the park. The code enforcement board said the fine would be imposed until a revised detailed development plan was submitted by the NCM and approved by the City-County Planning Commission of Warren County, which would lead to the issuance of a certificate of occupancy.

The code enforcement board originally issued a citation against the motorsports park on Aug. 20, with only a fixed $100 fine issued at that time.

The NCM, in its appeal, argues that the code enforcement board overstepped the bounds of that original fine when it then issued the $100-a-day fine in September and the other demands surrounding it. The Museum claims that the board acted “arbitrarily, erroneously and cannot place a lien on NCM property until the fine is paid and the certificate of occupancy is obtained.” Also being argued by the NCM is the board’s authority not to permit motorsports park events after Sept. 13.

Named in the NCM appeal are Warren County Judge-Executive Mike Buchanon; Warren County Attorney Amy Milliken; Alan Stonex, code enforcement board chairman; Josh Moore, code enforcement board director; Steve Hunter, executive director of the planning commission; Megan Mooney, administrative group manager of the planning commission; and Frank “Hamp” Moore, planning commission attorney.

In a separate related case, Warren Circuit Judge John Grise on Monday set a jury trial for Nov. 1, 2016 to consider possible monetary damages for Clark Circle homeowners because of the vehicle noise coming from the motorsports park. Earlier, Grise had denied a temporary restraining order requested by Residents Against Motorsports Park Track Noise LLC asking for the park to be closed down.
